SHIPPING POLICY

ARTICLE 1PURPOSE

The purpose of this shipping policy is to define the terms and conditions applicable to the shipment of a Product to the Customer by the Publisher.

ARTICLE 2STAKEHOLDERS

This shipping policy is applicable between Noxus Lab, hereinafter “the Publisher” and any person, natural or legal, private or public, registered on the Site to purchase a Product, hereinafter “the Customer”.

ARTICLE 3 – SCOPE OF APPLICATION

The Site is freely accessible to all Internet users. Browsing the Site implies acceptance by all Internet users of this shipping policy. Simply connecting to the Site, by any means whatsoever, including through a robot or a browser, will imply full and complete acceptance of this shipping policy.

The Internet user also acknowledges having fully understood them and accepts them without restriction.

When registering on the Site, this acceptance will be confirmed by checking the corresponding box.

Checking the above box will be deemed to have the same value as a handwritten signature from the Internet user. The Internet user acknowledges the evidentiary value of the Publisher's automatic recording systems and, unless he provides proof to the contrary, he waives the right to contest them in the event of a dispute.

This shipping policy applies to the relationship between the parties to the exclusion of all other conditions, and in particular those of the Internet user.

Acceptance of this shipping policy assumes that Internet users have the necessary legal capacity to do so, or failing that, that they have the authorization of a guardian or curator if they are incapable, of their legal representative if they are minors, or that they hold a mandate if they are acting on behalf of a legal entity.

ARTICLE 4 – DELIVERY

Delivery costs:

The delivery or provision costs will, in any event, be indicated to the Customer before any payment.

The delivery costs indicated on the Site are in euros, all taxes included.

Delivery time :

Orders are delivered by La Poste, Lettre suivi, Colissimo, Delivengo. Mondial Relay, Relais Colis, DPD or any other carrier depending on the geographical shipping locations within a reasonable period of 2 to 3 weeks from the full payment of the price by the Publisher, to which may be added in rare circumstances 1 to 2 weeks of delay in the event of a problem with customs reception.

Certain order volumes or delivery destinations may nevertheless justify a significant delivery time. This will be expressly mentioned to the Customer when confirming the order.

The seller cannot be held responsible for any delay in delivery.

Home delivery or relay point:

All deliveries can be made either to the Customer's home or to the nearest relay point, depending on the convenience and preferences of the carrier. This flexibility ensures optimal delivery tailored to the Customer's needs, taking into account logistical constraints and the specificities of each geographical area. In the case of delivery to a relay point, the customer will receive an email from the carrier indicating the address of the relay point where they can collect their package.

Damaged package:

In the event of delivery of a package that is clearly and visibly damaged, it is the Customer's responsibility to refuse it in order to benefit from the guarantee offered by the carrier. The Customer must also inform the seller without delay, so that a new package can be prepared for them and then shipped upon receipt of the damaged package in return. In such a case, the delivery times indicated above in these general conditions will no longer be applicable.

Retention of title - Transfer of risks:

Ownership of the Products delivered is reserved to the seller until delivery of the Products to the Customer, notwithstanding any clause to the contrary, unless the parties have punctually and expressly agreed in writing to waive this clause.

ARTICLE 5 – FINAL STIPULATIONS

Applicable law:

This shipping policy is subject to the application of French law.

Entirety:

The invalidity of one of the clauses of this contract shall not entail the invalidity of the other clauses of the contract or of the contract as a whole, which shall retain their full effect and scope. In such a case, the parties shall, as far as possible, replace the cancelled stipulation with a valid stipulation corresponding to the spirit and purpose of this contract.

Non-waiver:

The Publisher's failure to exercise the rights granted to it herein may not under any circumstances be interpreted as a waiver of the right to assert said rights.
